These Terms and Conditions govern your use of the Cropaite mobile application during the Phase 1 Pilot Programme. By installing and using the Cropaite app, you agree to these Terms.

By downloading, installing, or using the Cropaite App, you confirm that you have read, understood, and agree to be bound by these Terms. These Terms form part of a suite of documents governing your participation in the Pilot Programme, which includes the Pilot Agreement, the Data Consent Form, and the Non-Disclosure Agreement. In the event of any conflict between these Terms and those documents, the Pilot Agreement shall take precedence.
Access to the Cropaite App during Phase 1 is restricted to individuals and organisations that have:
You are responsible for keeping your Pilot Access Code, account credentials, and app login details confidential. You must not share your access credentials with any person who has not been individually registered as a Pilot Participant. Notify Cropaite immediately if you suspect any unauthorised use of your account.
The Cropaite AI disease detection model is a decision-support tool. It is designed to assist farmers and agronomists in identifying crop diseases more quickly and consistently โ it is not a substitute for the professional judgement of a qualified agronomist. The AI Diagnosis provided by the App is based on visual analysis of a single photograph at a single point in time, has a known margin of error, and should be cross-referenced with physical crop inspection and agronomist advice for high-value or export crops.
Important: Always cross-reference AI diagnoses with physical inspection and qualified agronomist advice before applying treatments to export or high-value crops.
During Phase 1, the Cropaite App is in active development and testing. The App may contain bugs or incomplete features, the AI model is being trained and improved in real time, and features may be added, modified, or removed during the Pilot period without prior notice.
Cropaite Technologies grants you a limited, non-exclusive, non-transferable, revocable licence to use the Cropaite App solely for the purposes of the Pilot Programme. You may use the App to:

You retain ownership of the farm data and scan images you submit through the Cropaite App. Cropaite does not claim ownership of your crops, your land, or your original farm data.
By submitting scan images and data through the App, you grant Cropaite a non-exclusive, worldwide, royalty-free licence to use, store, process, and analyse your User Data for:
Any feedback, suggestions, or feature requests you submit to Cropaite during the Pilot may be freely used by Cropaite to improve the platform without any obligation to compensate or credit the submitter. By submitting feedback, you assign any intellectual property rights in that feedback to Cropaite.
All intellectual property comprised in or associated with the Cropaite App belongs exclusively to Cropaite Technologies. This includes:
Nothing in these Terms transfers any intellectual property rights to the Participant.
To the fullest extent permitted by Kenyan law, the Cropaite App and all content, AI diagnoses, and treatment recommendations are provided on an "as is" and "as available" basis without any warranty of any kind. Cropaite makes no warranty that:
To the fullest extent permitted by law, Cropaite Technologies shall not be liable to any Participant for any indirect, incidental, special, consequential, or punitive loss arising from use of the App, including:
As the Pilot is provided free of charge, Cropaite's total liability to any Participant shall not exceed KES 0 during Phase 1.
You agree to indemnify, defend, and hold harmless Cropaite Technologies, its directors, employees, contractors, and agents from and against any claims, damages, losses, costs, or expenses arising from:
These Terms remain in effect for the duration of the Pilot Programme as specified in your Pilot Agreement.
Either party may terminate the licence to use the App by giving seven (7) days' written notice to the other party.
Cropaite may terminate your access immediately and without notice if you breach these Terms, submit fraudulent or manipulated data, use the App for any unauthorised commercial purpose, or if continued access poses a legal, reputational, or technical risk to Cropaite or other Pilot Participants.
On termination, your licence to use the App ends immediately. The following provisions survive termination: Sections 7.2, 8, 9, 10, 11, and 14.
